The IRS defines this form as “other than Form W-2,” which must be reported as wages in box 2 on your W-2. If this form is sent, the company sends the correct amount to the IRS. If the employee files it himself at the IRS, or another agency, he can request his share before it is sent. Why is IRS 1099-MISC good? Employers can get an indication that the money received by the employee will be spent according to IRS requirements. This makes it easier to pay people on time. If the employee receives his wages via mail (via bank transfer) or credit card, there can be delays to ensure the payment of the taxes. The 1099-MISC is a way for an employer to know where their employees are spending their wages.

Generally, a taxpayer only needs to complete the 1099-MISC forms if there are changes after the due date. For example, an employer may decide not to match contributions made to the IRS, because the employer believes the employer match will be forfeited if the employer matches. In this situation, the taxpayer needs to apply for, and mail to the IRS the correct information by the due date to avoid penalties. If a filing requirement is due prior to the due date, the taxpayer can correct it and file a 1099-MISC with the IRS. A 1099-MISC form indicates that the IRS is correct in its tax assessment (tax refund/credit) and that a tax liability does not exist. For example, instead of a 500 refund, the taxpayer receives a 1,000 refund. A 1099-MISC is not needed to correct the mistake. For example, if an employer does not match employee contributions made to a 401(k) plan by December 31st, the payment is considered to be a contribution made after the due date, and the 500 refund is considered to be a refund. On the other hand, if the employer does match contributions made to the 401(k), and the employee makes a contribution after the due date on her/his tax return, but a matching contribution is not made to the 401(k), the 500 and refund received will constitute a contribution made after the due date. The 500 is a non-matching contribution. On the other hand, if employees have non-payroll deductions, an employer can exclude up to 2,000 of those contributions from their taxes. These contributions need to be reported as non-employee compensation, and a 1099-MISC form must be completed by the employee to avoid penalty. What do 1099-MISC Forms Include? A 1099-MISC includes information the IRS needs to determine the amount that can be claimed in your refund/credit. Specifically, a 1099-MISC must indicate whether: There is a non-employee compensation requirement. For example, contributions made by employees to a 401(k) plan in excess of limits. The employee and employer have completed a matching plan. There is more than one taxpayer from the same tax year.

The IRS 1099-MISC is an electronically-delivered, self-certifying form that provides instructions for reducing taxes or withholding income and other information to the Internal Revenue Service. Generally, those who file Forms 1040, 1040A, or 1040EZ receive a 1099-MISC for each dollar of tax, interest, and/or estimated tax paid or subtracted. In addition to reducing your tax liability, the 1099-MISC will increase your refund, and the IRS has additional rules for taxpayers to meet. The IRS 1099-MISC is not a substitute for Form W-2. If you are required to file a tax return, you must receive a tax return electronically or by paper. The IRS defines 1099-MISC as: “A Form W-2, Certificate of Withholding and Estimated Tax, a Form 1099-MISC or Form 1099-MISC-EZ, Employer's Estimated Tax Payment” That's it! That's one IRS form. There is no form 1099-MISC-R when working for a private company, except for a business owner who is covered by the company's tax shelter. There is only one type of 1099-MISC issued by the IRS. What do I need to do after a 2-MISC is filed? If the IRS believes that the wages reported on your W-2 are not accurate, it may require you to file an amended 1099-MISC. It's best to have a copy of your W-2 and have your wages assessed right away. It's also a good idea to keep an accurate record of this process (this is the form with the “W-2” on it) to help your employer. Remember: If your wage is correctly assessed, you'll be entitled to the correct amount of income tax withheld from your wages. If the wages are not correct, your employer is subject to penalties and interest. What should I do with my W-2? You should immediately receive the W-2 form that lists the wages you paid (including tips) during the calendar year. The W-2 form also lists the dollar amounts paid to the employer each month and the date of the payment. Include this number on any 1098-T, 1099-MISC, T4 slip you need to file, or W2 packet. If you do not keep records of your wages, the employer will be in violation of the federal income tax laws. If the IRS believes the wages paid were “unallowable deductions”, you would either need to file an amended W-2 or provide the IRS with a certified statement that you didn't under-pay. What should I do after a missed deadline and missed income? If you paid your taxes by the due date, the IRS will automatically assess and withhold a deficiency. It means the IRS is not due any tax at the time of return submission.
To answer this, start by looking at the percentage of income reported on a form 1099-MISC that's reported on the line labeled “Other income and deductions.” That number is what I call “gross income.” You may be surprised to learn that less than half of gross income, 48.3%, is reported on the line labeled “Employed income.” So, for the sake of comparison, we'll use the percentage listed on IRS Form 1099-MISC for other income and deductions in our example. What is the median gross income reported on each form 1099-MISC? In our example, in 2012 that would mean that the median gross income from the 1099-MISC line would be about 2,700. So, just for the sake of our example and to be conservative, we'll use the value of 2,700. How many people filled out those forms and what taxes were paid on those forms? If we have the median 2,700 gross income reported and the median income on the line labeled “Other income and deductions,” then we have a total of 1,049,700 tax returns. That's close enough to a 99% match if all those people had filed returns like those we are looking at. For the sake of argument, that amount might be close enough. How many people paid taxes on those returns? If the median tax payment on those 1099-MISC forms was 2,700, then the total income tax paid on This is 32,700. What was the total sum of all income and deductions (not just taxes, such as income withheld) reported on any form 1099-MISC? Of the 32,700 total tax payments, 21,900 (22,200 from the 3,900 salary, 2,700 from the 1099-MISC line, and 3,900 from the “Other income and deductions”) was reported on Forms 1099-MISC. If we want to estimate the income for this 21,900 that was reported on those forms, we can calculate a minimum income. We don't want to use the IRS Form 1099-MISC because we know it's not true income. Instead, we need some way to come up with our approximate minimum income. How do I do that? We can try our hand at the Econ 101 problem. Suppose I'm given a number 21,900.
Yes. For 2012 tax returns, taxpayers have until the 31st of February to certify that their 2010 tax return for that tax year was filed, and a Form 1099-MISC is due on or before April 15, 2012. This form must be signed, under penalty of perjury, by the taxpayer. How does the IRS ensure that all employees receive the tax forms? Employees can obtain a copy of their income tax forms on IRS.gov, or by mail. When employees are not working, IRS Forms 1099-MISC are posted on IRS News website. Employees receive IRS Forms 1099-MISC through mail by providing their account number or payee and the TIN for the check to IRS. They also may receive IRS Forms 1099-MISC by fax. Please note that the receipt of your Form 1099-MISC is not an acknowledgment that you are paying Federal income taxes; merely the confirmation you provided to the IRS that your 2010 tax return for that year was included on IRS.gov after you submitted it electronically. It is simply to confirm to the IRS that you are filing your 2010 tax return and for the IRS to issue a form indicating that you paid the correct amount. What if I received a Form 1099-MISC from my employer? Can I cancel it? No — Form 1099-MISC form issued to you by your employer must be filed by the IRS on or before April 15, 2012. What is a refund? A refund is a monetary payment received by the IRS from a taxpayer whose tax liability has been eliminated; that is, the taxpayer no longer owes any tax. A refund check is issued to the taxpayer immediately upon submission of the Form 1099-MISC under penalty of perjury. There are many forms of refunds, the following are the key ones: Income tax refunds: Income tax liability is reduced (the amount of tax paid is not refunded, the taxpayer gets a refund check). Income tax withholding: When a Federal tax bill was deposited in the mail, a tax refund was sent to the recipient. State tax refunds: If a federal and state tax deduction(s) was allowed on an individual income tax return for a tax year. Families/business refund: Taxpayers who file a joint tax return in a year file a joint tax return.
